CONSTRUTORA UNI LTDA, a legal entity governed by private law, located at Rua Alagoas, 730 - 2nd floor, rooms 1 and 2 - Savassi, Belo Horizonte - MG, 30130-165, registered with the CNPJ under No. 02.671.904/0001-74, in this act represented in the form of its Articles of Incorporation, is committed to protecting your privacy, hereinafter referred to as CONSTRUTORA UNI.

Our Privacy Policy is designed to communicate our practices regarding the collection, use and disclosure of information that the USER may provide through service in our administration, office, telephone, messages, website and other associated websites, microsites, applications and subsites.

In order for our services to be offered in the best possible way, our team, website and platform collects various data and information, in order to offer the best experience and efficiency for you. We at CONSTRUTORA UNI are aware of the importance of your privacy and we take all possible measures to ensure it.

 

  1. The conditions and information presented in this term are in accordance with Brazilian legislation, including the terms of  Law no. 13,709/2018  (“LGPD – General Data Protection Law”) and related regulations.

Acceptance of the terms of this policy will be carried out through access to our websites, after your registration on the first access to our platform (portal or mobile application) or, in exceptional cases, through email. With this acceptance, you declare knowledge and full agreement on how your information and data will be used.

 

DATA CONTROLLER

 

  1. When this policy mentions “CONSTRUTORA UNI”, “we”, “us” or “our”, as well as grammatical variations of the first person plural, it refers to CONSTRUTORA UNI who is responsible for your information under this Privacy Policy ( the “Data Controller”).

 

DATA COLLECTION AND ACTIVITIES

 

  1. The USER's personal data and information will always be voluntarily submitted by the USER and may be collected in the following ways:

7.1. The USER's data is provided by the USER and collected by the internal team of CONSTRUTORA UNI, through telephone, letter, email, WhatsApp or chat.

7.2. USER data is provided by the USER and collected by the platform provided by CONSTRUTORA UNI (portal, application or website).

8.1. Full name; Identity, CPF, CNH, residential address, contact telephone number, e-mail, photo, biometrics, Username and password specific to the use of CONSTRUTORA UNI services.

8.2. IP address, USER registration date and time, USER exit date and time, device, model, operating system, country, region of the updated location at the time of access, actions on the platform or website.

8.3. Data used to improve the USER experience on the platform or website:

  • Ex.: Android Advertising ID (COMPLETE AS THE CASE)

8.4. The activities and actions carried out by the USER and recorded on the platform or website include, but are not limited to (i) screens accessed, (ii) date and time of actions performed, (iii) operations carried out within the platform or website and (iv) data about the USER's behavior within the platform or website.

8.5. The Platform may also make use of technologies such as (i) cookies, and the USER is responsible for configuring their Internet browser if they wish to deactivate them, see the topic.

a) allow you to access and use the Platform;

c) if you provide us with your contact information, we may process that information to: (i) facilitate your referral invitations, (ii) send your requests for referrals, (iii) fraud detection and prevention, and (iv) any purpose that you authorize at the time of data collection;

d) to operate, protect, improve, optimize the experience and the Platform, customize and shape your experience.

14.1. We process this personal information for these purposes due to our legitimate interest in using it to improve the CONSTRUTORA UNI Platform and our USERS' experience.  In addition, we process such information where necessary for the proper performance of the environment.

  1. We may use personal information to create and maintain a trusted and secure environment, such as to:

a) detect and prevent fraud, spam, abuse, security incidents and other harmful activities;

b) carry out security investigations and risk assessments;

c) verify or authenticate the information or identification provided by you;

d) comply with our legal obligations;

15.1. In connection with the above activities, we may perform profiles based on your interactions with the CONSTRUTORA UNI platform, your profile information and other content that you submit to the platform and information obtained from third parties. If you dispute the decision based on the automated process, please contact us as provided in the Contact Us section below.

  1. We process this personal information for these purposes due to our legitimate interest in protecting the Platform, to assess compliance with applicable laws.

 

  1. We may use personal information to provide, personalize, measure and improve our advertising and marketing, such as to:

a) send you promotional, marketing messages, advertising reports and other information that may be of interest to you and advertisements on social media platforms such as Facebook or Google);

b) customize, measure and improve our advertising;

c) administer promotional activities or events sponsored or managed by CONSTRUTORA UNI;

d) invite you to relevant events and opportunities.

17.1. We will process your personal information for the purposes listed in this section, considering our legitimate interest in carrying out marketing activities that may be of interest to you.

SHARING AND DISCLOSURE

 

  1. CONSTRUTORA UNI does not disclose to third parties any information provided by the USER through the website and/or platform, except:

a) in cases where CONSTRUTORA UNI is obliged to disclose or share the USER's personal data, in order to comply with any legal obligation (for example, by virtue of a court order, or for the purposes of preventing fraud or other crimes as well as in response to a request for information submitted by a competent authority, if we believe that disclosure complies with or is required under applicable laws, regulations or procedural procedures;

b) to protect the rights, assets and/or security of the platform, of the USERS of the site, or of any third parties. This includes exchanging information with other companies and organizations for fraud protection purposes;

c) CONSTRUTORA UNI may share information with the general public if you submit content to an open forum, such as blog comments, social media posts or other resources available through our services and visible to the general public;

d) we may share information with third parties who you choose to let us share information with, for example, in the case of other applications or websites that integrate our platform;

e) we may share information with partners who need access to the information to perform work on our behalf;

f) if, upon notice, you agree to share them; in an aggregated and/or anonymous form that cannot be used to identify you.

RESPONSIBILITIES

 

  1. The USER is solely responsible for:

a) for any and all acts or omissions performed by him from his access to the Internet, the Website and/or Platform of CONSTRUTORA UNI;

b) for any and all content uploaded, sent and/or transmitted to the Site and/or Platform;

c) for the repair of any and all damages, direct or indirect (including those resulting from violation of any rights of other USERS, third parties, including intellectual property rights, confidentiality and personality), that are caused to CONSTRUTORA UNI, at any another USER, or even to any third party, including due to non-compliance with the provisions of this Privacy Policy or any act performed from their access to the Internet, the Site and/or Platform.

  1. Under no circumstances will CONSTRUTORA UNI be responsible for:

a) for any act or omission performed and/or damage caused by the USER resulting from access to the Site and/or Platform;

b) for the misuse of the Site and/or Platform by any USER or third parties and/or for the contents uploaded, sent and/or transmitted to the Site and/or Platform by the USERS;

c) due to failures, technical impossibilities or system unavailability;

d) installation of viruses, trojans, malware, worm, bot, backdoor, spyware, rootkit, or any other devices that may be created, as a result of the USER's Internet browsing, on the USER's or third parties' equipment.

  1. The USER declares to be aware that any and all contents sent and/or transmitted to the Site and/or Platform by any USER and/or third parties do not represent, in any way, the opinion or vision of CONSTRUTORA UNI.

If the USER fails to comply with any provision of this Privacy Policy or legal provision, without prejudice to other measures, CONSTRUTORA UNI may, by itself or by third parties, at any time, at its sole discretion, without the need for any prior or subsequent notice or notification to any USER or any third party, by any means or form, without prejudice to initiating the appropriate legal measures, suspending or limiting access to the Site and/or Platform, terminating the access of any USER and/or taking other measures that it deems necessary for compliance with this Privacy Policy and for the proper functioning of the Site and/or platform, at any time.

USER RIGHTS

 

  1. You may exercise any of the rights described in this section with your CONSTRUTORA UNI Data Controller by sending an email to  lgpd@construtorauni.com.br  Please keep in mind that we may ask you to confirm your identity and request before taking any action on your order.

 

  1. You can access and update some of your information through your USER access settings on the CONSTRUTORA UNI website and/or platform. You are responsible for keeping your personal information up to date.

 

  1. You have the right to ask us to correct incorrect or incomplete personal information concerning you, which you cannot change through your USER access to the CONSTRUTORA UNI website and/or platform.

 

  1. In accordance with applicable law, you may request copies of your personal data held by CONSTRUTORA UNI. You may also request copies of personal data that you have provided to us in a structured, commonly used and human-readable format and/or request that we send this information to another service provider (where technically feasible).

 

  1. In general, we keep your personal data for as long as necessary. If you no longer want us to use your information, you can request that we erase your personal information and close your USER access. Please note that if you request the deletion of your personal information:

a) we may retain some of your personal information as necessary for our legitimate business interests, such as fraud detection and prevention and security improvement;

b) we may retain and use your personal information to the extent necessary to comply with our legal obligations. For example, legal reports and audits;

c) even after your USER access is removed some copies of your information (eg log records) may remain in our database but are disassociated from your USER;

d) as we maintain the CONSTRUTORA UNI website and/or platform to protect against accidental or malicious loss and destruction of data, residual copies of your personal information cannot be removed from our backup systems for a limited period.

  1. If we are processing your personal data based on your consent, you may withdraw your consent at any time by changing your USER settings or by sending an email to lgpd@construtorauni.com.br  specifying which consent you are withdrawing. Please keep in mind that the withdrawal of your consent does not affect the lawfulness of any processing activities based on such consent prior to its withdrawal.

 

  1. In accordance with applicable law, you may require CONSTRUTORA UNI not to process your personal data for certain specific purposes. If you object to such processing, CONSTRUTORA UNI will no longer process your personal data unless we can demonstrate compelling legitimate grounds for such processing or unless such processing is necessary for the establishment, exercise or defense of legal claims. When your personal information is processed for direct marketing purposes, you can request at any time that CONSTRUTORA UNI stop processing your data for these purposes by sending an email to lgpd@construtorauni.com.br  

 

  1. You have the right to file complaints about our activities by filing a complaint with our Data Protection Department, which can be accessed through the “Contact Us” section below or with a controlling authority under the General Data Protection Act.

OTHER IMPORTANT INFORMATION

CONSTRUTORA UNI belongs to: (i) any and all software, application or functionality used referring to the Site and/or Platform for USERS to access; (ii) the visual identity of the Site and/or Platform (including the graphic-visual art project of any of its pages); (iii) the corporate name, trademark, domain name, slogan or advertising expression or any distinctive sign of its ownership inserted on the Site; and (iv) any and all content created and produced by CONSTRUTORA UNI, by itself or by third parties, which may not be used, in any way, by USERS.

31.1. In cases where the Sites and/or Platform allow the sending and/or transmission of Content by the USER, the USER grants free, non-exclusive, irrevocable and irreversible authorization to CONSTRUTORA UNI to use any and all intellectual rights (including copyright and related rights) assets on any Content, sent and/or transmitted by the USER to the Site and/or Platform, in any way or form, at its sole discretion, without any restriction or limitation of any nature. The USER declares and guarantees that the Contents do not infringe the rights of third parties and that they have obtained all necessary authorizations to enable their use by CONSTRUTORA UNI.

  1. We are continually implementing and updating administrative, technical and physical security measures to help protect your information from unauthorized access, loss, destruction or alteration. Among the protections we use to defend your information are firewalls, data encryption and information access controls. If you know or have reason to believe that CONSTRUTORA UNI credentials have been lost, stolen, misappropriated or compromised, or in case of actual or suspected unauthorized use of your data, please contact us at lgpd@construtorauni.com .br  .

 

  1. Personal data held by CONSTRUTORA UNI may be transferred and stored in countries other than Brazil, including countries in the European Economic Area (“EEA”). It may happen that these countries do not have the same data protection laws in force in Brazil.   1. Tolerance regarding the possible non-compliance with any of the provisions of this Privacy Policy by any USER will not constitute a waiver of the right to demand compliance with the obligation, nor forgiveness, nor alteration of what is set forth herein.

 

  1. CONSTRUTORA UNI reserves the right to modify this Privacy Policy at any time in accordance with this provision. Therefore, we recommend periodically visiting the Privacy Policy so that you are aware of the changes. If we make changes to this Privacy Policy, we will post them at the link /privacy-policy/, and update the “Last Updated” date at the top of this Privacy Policy.

LEGISLATION AND JURISDICTION

 

  1. This Privacy Policy is governed by Brazilian law. Any disputes or controversies arising from any acts performed within the scope of the use of the Sites and/or Applications by USERS, including in relation to non-compliance with this Privacy Policy or violation of the rights of CONSTRUTORA UNI, other USERS and/or third parties, including intellectual property rights, secrecy and personality, will be processed in the District of the Capital of the State of Belo Horizonte.
